These Terms and Conditions govern the provision of rubbish clearance and waste collection services by Rubbish Clearance Kensington to domestic and commercial customers within our service area. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, or organisation requesting and paying for the services.

Services means any rubbish clearance, waste removal, waste collection, house clearance, office clearance, garden waste removal, or related services provided by Rubbish Clearance Kensington.

Waste means any rubbish, refuse, junk, or unwanted items to be collected, removed, or disposed of as part of the Services, including household, commercial, and garden waste, subject to applicable regulations.

Visit means a scheduled attendance of our collection crew at the address provided by the Customer for the purpose of performing the Services.

Agreement means the contract formed between Rubbish Clearance Kensington and the Customer when a booking is accepted, on the basis of these Terms and Conditions.

2. Scope of Services

Rubbish Clearance Kensington provides rubbish clearance and waste collection services to residential and commercial premises within our operational area. The exact scope of each Service will be agreed at the time of booking, including the type of waste, approximate volume or weight, location within the premises, and any access limitations.

Our Services cover non-hazardous waste and certain categories of bulky items. Some types of waste, including but not limited to asbestos, clinical waste, chemicals, pressurised containers, gas bottles, and certain electrical items, may be restricted or require prior written agreement. The Customer is responsible for informing us in advance about any unusual or potentially hazardous items so that we can confirm whether we can accept them and on what terms.

We reserve the right to refuse to remove any waste that we reasonably believe is hazardous, illegal, unsafe to handle, contaminated, or not as described at the time of booking.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through any booking system we make available. When making a booking, the Customer must provide accurate information about the type and estimated amount of waste, property access, parking arrangements, and any relevant site conditions.

3.2 A provisional quote will normally be provided based on the information given. This quote is an estimate only and may be adjusted at the Visit if quantities, types of waste, or access conditions differ from those described.

3.3 A booking is not confirmed until we have accepted it and, where required, the Customer has paid any requested deposit or pre-payment. Once accepted, the booking will form part of the Agreement between the Customer and Rubbish Clearance Kensington, subject to these Terms and Conditions.

3.4 We will use reasonable efforts to attend at the agreed time and date. However, all arrival times are estimates only and may be affected by traffic, weather, or operational factors. Where possible, we will inform the Customer of any significant delay or need to reschedule.

4. Pricing and Quotes

4.1 Prices are generally based on the volume and type of waste collected, the time required to load, and any special handling or access requirements. Price information is available on request and may be updated from time to time.

4.2 Any quote given before a Visit is indicative and based on the description provided by the Customer. The final price will be confirmed on site once our team has inspected the waste and assessed the actual circumstances.

4.3 If, on arrival, we find that the waste volume, type, or labour required materially exceeds that described at the time of booking, we may revise the quote accordingly. If the Customer does not accept the revised price, we are entitled to cancel the Service for that Visit. In such cases, a call-out or cancellation fee may be charged to cover our costs.

4.4 All prices are quoted in pounds sterling and are inclusive or exclusive of VAT as stated at the time of booking. We reserve the right to change our pricing structure and rates, but such changes will not affect confirmed bookings that have already been accepted.

5. Payments

5.1 Payment is due on completion of the Visit, unless otherwise agreed in writing. For some bookings, particularly for commercial customers or larger clearances, we may require advance payment or a deposit.

5.2 We accept payment by the methods stated at the time of booking, which may include card payment, bank transfer, or cash. We do not accept payment by cheque unless previously agreed.

5.3 For account customers or commercial agreements, invoices are payable within the payment terms stated on the invoice. If no payment term is stated, the default term is 14 days from the date of invoice.

5.4 If the Customer fails to pay any amount when due, we may charge interest on the overdue amount at the statutory rate allowed under UK law for late payment, from the due date until the date of actual payment, whether before or after judgment.

5.5 We reserve the right to withhold or suspend Services at any time if the Customer has outstanding unpaid invoices or has previously failed to pay on time.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting us directly. To avoid charges, we ask that at least 24 hours notice is given for cancellations or significant changes to a booking time, date, or scope.

6.2 If the Customer cancels a booking with less than 24 hours notice, we may charge a reasonable cancellation fee to cover any costs incurred and any loss of opportunity to rebook the timeslot.

6.3 If our team attends the property at the agreed time and is unable to carry out the Service due to the Customer not being present, lack of access, restricted parking, unsafe conditions, or the Customer otherwise not being ready, this may be treated as a late cancellation. In such cases, we may charge a call-out fee and any associated waiting time.

6.4 We may cancel or reschedule a booking if we are unable to perform the Services due to reasons beyond our reasonable control, including but not limited to extreme weather, accidents, staff illness, vehicle breakdown, or changes in legal requirements. In these circumstances, we will use reasonable efforts to notify the Customer and to rearrange the Visit at a mutually convenient time. We will not be liable for any loss or inconvenience arising from such cancellation or rescheduling, except for any refund of sums already paid for Services not provided.

7. Customer Obligations

7.1 The Customer must ensure that our team has safe and suitable access to the property and to the waste to be collected, including any gates, stairways, lifts, or outbuildings. The Customer is responsible for arranging necessary parking permissions or permits where applicable.

7.2 The Customer must ensure that the waste presented for collection matches the description given at the time of booking and is not contaminated with hazardous or prohibited materials. We may request that certain items are separated or clearly marked.

7.3 The Customer must ensure that children, pets, and other occupants are kept at a safe distance from any work area while the Services are being carried out.

7.4 Where we are required to collect items from inside the premises, the Customer must clear a safe route and protect any fragile items or surfaces that may be at risk. While we will take reasonable care, we cannot be held responsible for damage arising from the movement of large or heavy items through restricted spaces where the risk of damage could not reasonably be avoided.

8. Liability and Limitations

8.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.

8.2 Subject to the above, our total liability to the Customer for any loss or damage arising out of or in connection with the provision of Services, whether in contract, tort, or otherwise, shall not exceed the total amount paid or payable by the Customer for the relevant Visit.

8.3 We will not be liable for any indirect or consequential loss, including but not limited to loss of profit, loss of business, loss of opportunity, or loss of data, arising from or in connection with the Services or any delay or failure to perform.

8.4 The Customer is responsible for ensuring that any items to be removed are genuinely unwanted. Once removed, waste is not recoverable. We accept no liability for items that the Customer or a third party later claims were removed in error, unless such removal was clearly contrary to the written instructions provided.

8.5 We are not responsible for pre-existing damage to any part of the property or to any items that we are requested to move. Any claim for damage allegedly caused by our team must be reported to us in writing within 48 hours of the Visit, providing full details of the damage and supporting evidence such as photographs.

9. Waste Handling and Environmental Compliance

9.1 Rubbish Clearance Kensington operates in accordance with applicable UK waste management legislation and environmental regulations. We will transport and dispose of waste using authorised facilities and routes, and we will take reasonable steps to maximise recycling and responsible disposal.

9.2 Once waste is loaded into our vehicle and payment has been made or agreed, ownership of that waste transfers to us. We will then be responsible for its proper handling, transport, and disposal in line with the law.

9.3 Customers must not request or encourage our staff to dispose of waste illegally or to leave waste in unauthorised locations. We reserve the right to withdraw our Services and, if appropriate, report matters to the relevant authorities if we believe unlawful disposal is being sought or has occurred.

9.4 In the case of commercial Customers, we may provide waste transfer notes or other required documentation to evidence proper disposal. The Customer is responsible for retaining these records as required by law.

10. Prohibited and Restricted Items

10.1 Certain categories of waste cannot be accepted as part of standard rubbish clearance services. These may include, without limitation, asbestos, clinical and medical waste, chemicals and solvents, explosives, ammunition, biological waste, gas cylinders, and other high-risk materials.

10.2 Some electrical items, tyres, refrigeration units, and other specific wastes may be subject to separate regulations and may incur additional charges or require specialist handling. The Customer must notify us in advance if such items are to be included so that we can confirm whether we can accept them and provide an appropriate quote.

10.3 If prohibited or undeclared restricted items are discovered during a Visit, we may refuse to collect them and may adjust the price or cancel the Service. The Customer will be responsible for any additional costs or legal consequences arising from providing such items for collection without prior agreement.

11. Access, Parking, and Site Conditions

11.1 The Customer must ensure that reasonable parking is available for our vehicles in close proximity to the property throughout the Visit. Any parking charges, fines, or penalties incurred due to incorrect information provided by the Customer or failure to arrange appropriate parking permissions may be charged to the Customer.

11.2 We reserve the right to refuse to carry out the Services or to stop work if site conditions are unsafe, unsanitary, or significantly different from those described at the time of booking, including the presence of vermin, dangerous structures, or aggressive behaviour.

11.3 Where we are required to carry waste over long distances, up or down multiple flights of stairs, or through particularly difficult access routes, additional labour or time-based charges may be applied. These will be explained to the Customer before work proceeds, wherever reasonably possible.

12. Complaints

12.1 We aim to provide a reliable and professional rubbish clearance service. If the Customer is dissatisfied with any aspect of our Services, they should contact us as soon as possible, providing full details of the issue.

12.2 We will investigate complaints in a fair and timely manner and will endeavour to resolve them to the satisfaction of both parties, where reasonably possible. Any remedies offered will be at our discretion, having regard to the circumstances and the extent of any proven fault on our part.

13. Data Protection and Privacy

13.1 We collect and process personal data such as names, contact details, service addresses, and payment information for the purposes of managing bookings, providing Services, processing payments, and meeting legal obligations.

13.2 Personal data will be handled in accordance with applicable UK data protection legislation. We will not sell personal data to third parties, and we will only share it where necessary to provide the Services, to process payments, or where required by law.

14. Amendments to These Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our operations, legal requirements, or industry practices. The latest version will apply to all new bookings made after the date of publication.

14.2 For ongoing commercial arrangements, we will notify the Customer of any material changes to these Terms and Conditions and will provide reasonable notice where practicable.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any Agreement between the Customer and Rubbish Clearance Kensington, are governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their subject matter or formation.

By placing a booking with Rubbish Clearance Kensington or by allowing our team to carry out a rubbish clearance, the Customer confirms that they have read, understood, and agreed to be bound by these Terms and Conditions.
